I often get asked, “What is PTI?” PTI stands for Pre-Trial Intervention. It's a diversion program that we often strive to get for our clients and, if our clients are eligible, we typically are successful in securing for our clients. PTI is only offered to people who have no prior criminal history or a very minor prior criminal history.
It does not require a guilty plea or a no-contest plea. More importantly, if you successfully complete PTI, it results in the dismissal of your case. Once your case is dismissed, you are eligible to have the charges expunged from your record on the Misdemeanor level.
PTI consists of three months of supervision along with certain conditions. You have to complete a class that's appropriate for the charge or related to the charge. You have to complete 15 hours of community service and you have to pay a couple of hundred dollars in costs upon successfully completing three months of supervision. The charge will then be dismissed and then you could apply to have it expunged from your record.
On the Felony level, PTI usually consists of twelve months of supervision and similar sanctions/conditions as for the misdemeanor level. There will be a class and there will be community service hours. There will often be a drug evaluation and drug testing depending on the nature of the charge.
A specific type of PTI on the Felony level is Drug Court. Drug Court is a twelve-month intensive program that is geared toward people who either abuse or are addicted to substances, whether it's alcohol or drugs. Upon successful completion of the twelve-month Drug Court Program, you could be eligible to have your charge dismissed. Drug Court requires weekly group meetings individual meetings and drug testing, but it is a great program that can result in the dismissal of a Felony charge against you.
