Article 356 talks about State Emergency The provision for the suspension of fundamental rights had been taken from = Weimar Constitution The idea of emergency in the Indian constitution was taken from = Government of India Act, 1935. - Important Amendments regarding Emergency:- -38th Amendment -39th Amendment -42nd Amendment: This is the most controversial amendment in Indian Constitutional history. 42nd Amendment is very important as it did major changes in the federal structure of the Indian Constitution - it is also known as Mini-Constitution -and 44th Amendment - which was mainly introduced to do away with the changes of the 42nd Amendment.
