The provision for the suspension of fundamental rights had been taken from = Weimar Constitution The idea of emergency in Indian constitution was taken from = Government of India Act, 1935. Article 356 = State Emergency Article 360 = Financial Emergency In this Video, Let us discuss Article 352 i.e., National Emergency: - what are the grounds on the basis of which Emergency is imposed - 1st Proclamation of Emergency (India - China), 1962 - 2nd Proclamation of Emergency (India - Pakistan, 1971 - 3rd Proclamation of Emergency or Emergency by Indira Gandhi (Internal Disturbance), 1975 - What is the impact of Emergency on Centre-State relationship i.e., Article 353 - Fundamental Rights of Indian Constitution and Emergency - Article 358 and Article 359 of the Indian Constitution - Important Amendments regarding Emergency:- -38th Amendment -39th Amendment -42nd Amendment: This is the most controversial amendment in Indian Constitutional history. 42nd Amendment is very important as it did major changes in the federal structure of the Indian Constitution - it is also known as Mini-Constitution -and 44th Amendment - which was mainly introduced to do away with the changes of the 42nd Amendment.
